This bill makes sense in some very important ways and is sponsored by Representatives from both parties: Democrat Rep. Jerrold Nadler of New York as well as Texas Republican Rep. Michael Burgess. Firstly, it allows Living Kidney Donors to take time off to recover after their Kidney Transplant surgery. The National Kidney Foundation notes, "the bill clarifies that living organ donors may use time granted through the Family and Medical Leave Act (FMLA) to recover from transplant surgery."

This is critical, because the fact that a donor cannot take time off of work is a huge factor that many consider when deciding AGAINST Living Kidney Donation. Well, now many can receive the time they need to recuperate after surgery without fear of losing their job. The United States Office Of Personnel Management states that upon return from FMLA leave, an employee must be returned to the same position or to an "equivalent position with equivalent benefits, pay, status, and other terms and conditions of employment." Moreover, an employee who takes FMLA leave is entitled to maintain their health benefits coverage.

Another major bonus of this Act is that Living Organ (Kidney) Donors will be protected from insurance discrimination by making it "unlawful" for Insurance Companies to decline, terminate, or limit the coverage of those who decide to donate their Kidney. What's more, Living Kidney Donors cannot be charged higher premiums for their life, disability, or long-term care insurance policies.
